Practice Description

No matter the size or nature of a company's workforce, labor and employment issues are critically important to ongoing success. Tonkon Torp's relationship-based approach offers practical solutions to labor and employment issues for a diverse group of employers. We help our clients manage employee relations, protect competitive positions, deal with union activity and defend employment litigation.

Counseling

We identify potential problem areas, develop appropriate policies and procedures, and train management and employees to prevent costly disputes. We help our clients comply with local, state and federal employment laws and minimize exposure to litigation.
Our counseling and training programs encompass:
  • Development of and compliance with policies covering harassment, discrimination and retaliation.
  • Wage and hour practices.
  • Compliance with state and federal leave requirements.
  • ADA and reasonable accommodations.
  • Employment application, hiring, evaluation and discharge procedures.
  • OSHA and workplace safety.
  • Non-compete, non-solicitation and nondisclosure agreements.
  • Employment contracts, executive compensation and employee benefits.
  • Plant closures, downsizing and layoffs, including WARN compliance.
  • Prevention of workplace theft and violence.
  • Employee handbooks.
  • Affirmative Action Plans.
  • OFCCP audits.

Litigation

When workplace disputes escalate, Tonkon Torp assists in resolving the dispute. Sometimes, the most appropriate action is settling disputes out of court. Other times, we have successfully represented our clients at trial and on appeal.

We defend employment claims before all levels of federal and state courts and agencies. Representative cases include:
  • Harassment and discrimination.
  • Retaliation and whistle blowing claims.
  • Wage and hour claims, including class actions.
  • Disability discrimination and accommodation.
  • Family and Medical Leave claims.
  • Wrongful termination and related tort and contract claims.
  • Employment contracts.
  • Pension and employee benefits.
  • Misappropriation of trade secrets and enforcement of non-competition agreements.

Labor Relations

We help clients work successfully on all union issues. Our attorneys represent employers with:
  • Union grievances and labor arbitrations.
  • Unfair labor practice actions with the NLRB.
  • Strikes and injunctions.
  • Union organizing campaigns.
  • Representation elections.
  • Collective bargaining.
