Parna Mehrbani Covers FTC #Compliance for Social Media Advertising and Influencers

On February 4, Tonkon Torp partner Parna Mehrbani was a featured panelist at a Lewis & Clark Law School “IP Business Series” program on “The Contracts Behind Influencer and Audience Arrangements” hosted by the Intellectual Property Student Organization (IPSO).

The panelists spoke to law students about the rise of influencer marketing on social media, what terms should be included in agreements with influencers, best practices for compliance with Federal Trade Commission (FTC) rules, and audience agreements in the music industry. Parna’s remarks focused on ways that both companies and the influencers they hire for social media advertising should comply with FTC guidelines regarding disclosure of their relationships. She gave advice on when an influencer should disclose a compensated relationship with a brand, how to appropriately disclose the relationship using hashtags, text on photo, or audio mentions, and where in a post the disclosure should appear. She also provided examples of how the FTC is enforcing violations of its disclosure guidance.

Parna is Co-Chair of Tonkon Torp’s Information Privacy & Security Practice Group, and a partner in its Intellectual Property Practice Group.
