Jon Stride, lead trial lawyer for Tonkon Torp's Intellectual Property practice group, successfully pursued trademark infringement and counterfeiting claims on behalf of AXTS (Salem, OR) and Rainier Arms.
AXTS manufactures high-quality aftermarket firearm parts. It co-brands the RAPTOR charging handle part for AR 15 rifles with Rainier Arms (Auburn, Washington) which is sold throughout the United States.
The claims were filed against defendant Arms Unlimited (Torrance, California), which was manufacturing and selling counterfeits of the RAPTOR charging handle on eBay, Amazon and its own website. Although of inferior quality, the counterfeit product bore the Rainier Arms trademark and logo. The case was resolved in the United States District Court for the District of Oregon by entry of permanent injunction, disclosure of counterfeit manufacturers, and payment for damages.
