H-1B Cap Reached for Fiscal Year 2005
October 4, 2004
This morning we received news from the United States Citizenship and Immigration Services (USCIS) that the annual quota (cap) of H-1B numbers available for Fiscal Year 2005 (FY2005) has been reached. Click the Download Client Update link above to view the USCIS press release dated October 1, 2004.
Now that the cap has been reached, the first available start date for new H-1B applicants subject to the cap is October 1, 2005. The earliest possible filing date for that start date is April 1, 2005. Never before has the H-1B cap been reached so early in the Fiscal Year, and this unprecedented event will have a wide ranging effect on United States businesses.
The Immigration Team at Tonkon Torp LLP is planning to hold an impromptu meeting over coffee later this week to discuss the implications of this development. Please let us know if you would be interested in getting together, and if so, what time and day would be convenient for you.
