FY2010 H-1B Numbers Remain Available

The USCIS has confirmed as of April 9 that approximately 23,000 of the 65,000 H-1B visas from the FY2010 quota remain available following the April 1 opening for filings. Employers should review their recruitment needs given the continuing availability of H-1Bs, and act promptly if interested in pursuing a cap subject H-1B for an employee or prospective applicant with an October 1, 2009 start date.

US-VISIT Extended to Permanent Residents

As of January 2009, U.S. Customs and Border Protection has extended the US-VISIT program to include U.S. permanent residents. Permanent residents returning from travel abroad are now required upon entry or re-entry to the United States to provide biometric data (digital photographs and fingerprints) as part of the inspections and admission process. This information is utilized to verify an individual's identity during inspection and prevent the use of fraudulent documentation. We recommend that Human Resources professionals notify lawful permanent resident employees of this change.
